Caregiver earns 6 months in welfare fraud case

Thursday, February 21, 2013

WENATCHEE — A woman accused of defrauding the state welfare system — at the same time she was neglecting and abusing the elderly couple she cared for — won a six-month jail sentence after a guilty plea Wednesday.

Sentenced for false welfare filing

Lena May Grove, 52, pleaded guilty to false verification for public assistance, admitting that she untruthfully filled out an application for aid to the state Department of Social and Health Services. Charges of first-degree theft by welfare fraud and second-degree perjury were dropped.

Grove was charged with the fraud in December, after serving nine months in prison for assaulting the aged couple she worked for and who had adopted her as their daughter. She filed an application for welfare in 2010 without disclosing the $3,600 monthly salary she drew from her adoptive parents to pay for their care.

She was arrested in April 2011 after sheriff’s deputies found Grove’s disabled parents, an 82-year-old woman and her 77-year-old husband, in unsanitary conditions in Grove’s north Wenatchee home. The woman had an injured wrist and the man had suffered facial bruises, broken ribs and a partially collapsed lung.

Both accused Grove of striking or otherwise physically abusing them, and said Grove refused to allow them access to a phone. She entered Alford pleas in May 2011 to two second-degree assault charges and one third-degree assault charge against her parents.

Grove’s public defense attorney, Robert Gower, told visiting Judge Chris Culp in Chelan County Superior Court that Grove suffered from depression and post-traumatic stress disorder, which probably contributed to the abuse and fraud. She also underwent surgeries for breast cancer during the same period, and three of her siblings died.

“Are things better now for you?” asked Culp, an Okanogan County judge filling in for Chelan County Judge Lesley Allan.

“Barely,” Grove told him.

Grove could have been sentenced to nearly two years in jail had the higher charges not been dropped. She must report for jail March 22. After serving her term, she’ll be forced to pay back $5,400 she received in fraudulent DSHS payments.

I am the husband of the daughter that this lady Grove was supposedly providing care for, and what it dosn't say is that her stepfather died in a rest home in chelan just a few months after this happened. Not only was he a broken Man but she had also knocked out his teeth and he was totally devastated. Her Mom is barely alive and broke after Grove had taken all the cash and savings, not only to buy a house but a big fancy SUV. As far as I know Grove has never been diagnosed with depression or PSD. What right does the Judge have to ask her "are things better for her now"she, Grove is a felon who has pleaded guilty and who is going back to jail, she caused great harm to people that trusted her for there well being and she failed miserably. As far as we are oncerned who cares if things are better for her now, she, Grove caused all of this herself and has gotten off nearly free for the pain that she caused.

I am so sorry that your family was so directly impacted by Grove's evil. And yes, she is EVIL. One has to wonder, just what has happened to our system of justice when such evil is allowed such a light sentence in light of her horrible actions.

When legal justice becomes a mockery of the intent behind the rule of law, that is the time when the rule of law collapses and people turn to vigilantism.

My thoughts and prayers go to you and your family.

By no means excusing what this lady did but where was your wife?? You say your wife is the daughter of the lady Grove robbed and abused? Not implying anything but have seen too many in the nursing homes...forgotten and basically abandoned. People often ask, "how can God allow this to happen"
I would say How do WE allow these things to happen.? Take care of your parents and you will teach your children how to take care of YOU.

One of the articles in the paper states the jail is low on inmates! Why isn't this lady in jail for life what she did? I agree with coolers53, who cares how Lena is now. She does not care about anyone else but herself and her excuses mean nothing.
Unfortunately I had dealings with this lady many years ago and her behaviors were not nice. She needed help a long long time ago. The family she supposedly cared for suffers while she gets to start over. It is really not fair.
If there was any consistency in the judicial system they would make sure Lena gets the mental health help she NEEDS!

This is disgusting! Only 6 months for ruining several families lives. I truly hope karma gets her soon. It's sad, she has pretty much gotten away with this, and 6 months from now, she will be moving on to her next victim.

Can you tell us the name of the prosecutor who dropped the charges, Mr. Robbins? Was it Mr. Paulson, the same gentleman who put so much effort into persecuting the young Latino medical marijuana patient in the paper a few weeks ago?
