Change is difficult, obedience to federal law is not a bad position and Wenatchee may be a city willing to stand on principle, but please, can’t somebody else do it? This is no time to be the lone champion of marijuana prohibition. There is very little to gain.
Wenatchee, unfortunately, is what lawyers might call a sitting duck. The city has been sued in Chelan County Superior Court by a would-be marijuana retailer hoping to open a shop in Wenatchee under the rules set by Initiative 502, approved by the people of Washington and Wenatchee, which legalizes possession of marijuana and allows for its production and sale. The city requires any retailer to obtain a business license. The City Council let stand a longstanding rule that it will not issue a license to any business that does not comply with federal law. Marijuana, legalized by the state, is still a controlled substance in federal statutes. The city affirmed that any marijuana retailer will be denied a business license, for failing to comply with federal law. It is a de facto ban on businesses legal under state law.
